2. Description of the Application

KhataBook: Easy Hisab is a specialized, 100% offline-first digital cashbook and debit/credit ledger utility. The Application enables merchants, retailers, small business owners, contractors, freelancers, and individuals to locally record daily cash inflows, outflows, customer accounts, and expense transactions on their mobile devices without requiring internet connectivity or server-side account creation.

3.1 Not a Bank, Financial Institution, or Money Transmitter

KhataBook is strictly a record-keeping, computational, and bookkeeping software tool. MoboDevs is not a bank, credit union, depository institution, payment gateway, money services business (MSB), money transmitter, lender, credit broker, or escrow provider.

• The Application does not process, hold, deposit, settle, transmit, or custody real currency, legal tender, digital currencies, or monetary instruments.
• Recording a transaction in KhataBook does not constitute a legally verified transfer of funds, nor does it guarantee payment, settlement, or creditworthiness of any party.

3.2 Not Certified Accounting or Tax Advice

The Application, its features, reports (including PDF statements and CSV exports), and calculations are provided for organizational and bookkeeping convenience only.

• KhataBook does not constitute certified public accounting (CPA), statutory auditing, financial advisory, legal, or professional tax consulting services.
• You are solely responsible for ensuring that your bookkeeping records comply with all applicable local, regional, national, and international tax laws, VAT/GST filing mandates, accounting standards, and statutory preservation requirements.
• You should independently verify all arithmetic calculations, ledger totals, and export summaries prior to submitting them to regulatory bodies, tax authorities, or business partners.

4. Offline Architecture & Sole User Responsibility for Backups

PLEASE READ THIS SECTION WITH EXTRAORDINARY CARE.

4.1 100% Local Device Storage

KhataBook is engineered to operate without remote servers or cloud databases. All transactions, cashbooks, customer contacts, notes, attached bill images, and settings entered into the Application reside exclusively in the internal, sandboxed storage of your physical Android device.

4.2 Sole Responsibility for Data Retention & Backups

Because MoboDevs does not operate cloud servers, does not synchronize data remotely, and maintains no centralized user databases:

• MoboDevs does NOT possess, control, monitor, or back up your data.
• You bear 100% sole and exclusive responsibility for regularly creating, verifying, and preserving backups of your financial records.
• You are urged to use the in-app "Backup & Restore" feature to routinely export full database backups to an external storage medium, an SD card, or your personal cloud storage account (such as Google Drive or OneDrive) via Android's Storage Access Framework.

4.3 Total Irretrievability of Lost Data

MOBODEVS HAS ZERO ABILITY TO RESTORE, RECOVER, RETRIEVE, OR RECONSTRUCT YOUR FINANCIAL RECORDS UNDER ANY CIRCUMSTANCES. MoboDevs shall have no liability whatsoever for any loss of data, loss of business records, financial discrepancy, or corruption resulting from, but not limited to:

1. Physical device damage, destruction, loss, or theft.
2. Device operating system crashes, factory resets, formatting, or firmware updates.
3. User uninstallation of the Application or manual clearing of app data/cache via Android settings.
4. Storage hardware corruption, SD card failure, or operating system file system faults.
5. Forgotten 4-digit PINs, lost security recovery answers, or biometric sensor failures.

5.1 Device Security & Access Control

You are solely responsible for controlling physical access to your device and safeguarding the confidentiality of your device lock screen, in-app 4-digit PIN, and biometric authentication credentials.

5.2 Forgotten PINs & Security Bypass

• To protect your financial confidentiality, KhataBook enforces local cryptographic PIN hashing. MoboDevs possesses no backdoor, remote override, master PIN, or recovery mechanism to regain access to your application if you forget both your PIN and your security recovery answer.
• If you permanently lose your security credentials, you may be required to reset the Application via Android system settings, which will permanently destroy all unexported local ledger data.

Grant of License & Intellectual Property Rights

6. Grant of License & Intellectual Property Rights

6.1 Limited License Grant

Subject to your continued compliance with these Terms, MoboDevs grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and execute the Application on Android devices that you own or control, solely for your lawful business or personal bookkeeping purposes.

6.2 Ownership of Intellectual Property

All intellectual property rights in and to the Application—including but not limited to software code, architecture, algorithms, user interfaces, visual design, icons, graphics, documentation, and the "KhataBook" branding—are and shall remain the exclusive property of MoboDevs. All rights not expressly granted to you herein are reserved by MoboDevs.

6.3 Ownership of User Data

As between you and MoboDevs, you retain 100% exclusive ownership of all financial data, business records, transaction logs, notes, and receipt images that you enter into or generate with the Application. MoboDevs asserts no ownership, copyright, or proprietary claim over your business records.

Acceptable Use & Prohibited Conduct

7. Acceptable Use & Prohibited Conduct

You agree that you will not, directly or indirectly:

1. Reverse Engineer: Decompile, disassemble, reverse engineer, decipher, unpack, or attempt to derive the source code or underlying structure of the Application, except to the extent permitted by applicable mandatory law.
2. Unauthorized Modification: Modify, adapt, translate, enhance, or create derivative works of the Application.
3. Circumvent Security: Probe, scan, tamper with, bypass, or defeat any security mechanism, PIN verification, biometric check, or sandbox restriction embedded within the Application.
4. Unlawful Use: Use the Application for any unlawful, fraudulent, or illicit purpose, including but not limited to tax evasion, money laundering, financing terrorism, extortion, maintaining fraudulent business accounts, or violating economic sanctions.
5. Commercial Exploitation: Rent, lease, lend, sell, sublicense, distribute, or commercially host the Application or provide it as a managed service bureau without our express written consent.
6. Harmful Code: Introduce malicious code, viruses, Trojan horses, or unauthorized scripts designed to compromise system integrity.

8.1 Third-Party Platforms (WhatsApp, Email, Cloud Drives)

KhataBook includes features allowing you to export and share transaction slips, WhatsApp PNG voucher cards, A4 PDF statements, and CSV spreadsheets with third parties (such as clients, suppliers, accountants, or communication apps).

• When you choose to share a receipt or export a report, you do so voluntarily and at your own sole risk.
• Transmissions dispatched through third-party platforms (e.g., WhatsApp, Telegram, Gmail, Bluetooth) are subject exclusively to the terms and privacy practices of those respective third-party providers.
• MoboDevs is not responsible or liable for any interception, unauthorized disclosure, data breach, or misuse of your records once shared outside the sandboxed Application.

Disclaimer of Warranties

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED TO YOU STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND DEFECTS, AND WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, MOBODEVS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• ANY WARRANTY THAT THE APPLICATION WILL MEET YOUR SPECIFIC ACCOUNTING OR BUSINESS REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE COMPLETELY ERROR-FREE, BUG-FREE, OR COMPATIBLE WITH EVERY ANDROID DEVICE, OPERATING SYSTEM REVISION, OR THIRD-PARTY HARDWARE.
• ANY WARRANTY REGARDING THE ABSOLUTE ACCURACY, RELIABILITY, MATHEMATICAL PERFECTION, OR LEGAL SUFFICIENCY OF COMPUTATIONS, STATEMENTS, CURRENCY CONVERSIONS, OR REPORTS GENERATED BY THE APPLICATION.

YOUR RELIANCE ON THE APPLICATION AND ANY DATA OR CALCULATIONS OBTAINED THEREFROM IS CONDUCTED SOLELY AT YOUR OWN RISK.

Limitation of Liability

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOBODEVS, ITS AFFILIATES, DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

1. INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
2. LOSS OF PROFITS, REVENUE, SALES, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS;
3. LOSS, CORRUPTION, DAMAGE, OR UNAVAILABILITY OF DATA, RECORDS, OR FINANCIAL ENTRIES;
4. BUSINESS INTERRUPTION, COMMERCIAL DISPUTES, REGULATORY FINES, OR TAX PENALTIES; OR
5. COST OF PROCURING SUBSTITUTE SOFTWARE OR SERVICES;

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APPLICATION, EVEN IF MOBODEVS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).

IN ALL CASES, MOBODEVS’ AGGREGATE, CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATING TO THESE TERMS OR THE APPLICATION SHALL BE STRICTLY LIMITED TO THE GREATER OF:

• THE ACTUAL AMOUNT PAID BY YOU TO MOBODEVS FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
• TEN UNITED STATES DOLLARS ($10.00 USD).

Indemnification

11. Indemnification

You agree to defend, indemnify, and hold harmless MoboDevs, its developers, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal and attorneys’ fees) arising directly or indirectly out of:

1. Your violation or breach of any provision of these Terms;
2. Your use or misuse of the Application or reports generated therefrom;
3. Any dispute between you and any third party (including your customers, clients, vendors, or suppliers) regarding transactions recorded in KhataBook; or
4. Your violation of any applicable local, national, statutory, accounting, or tax law or regulation.

Modifications to the Service and Terms

12. Modifications to the Service and Terms

• Modifications to Application: MoboDevs reserves the right at any time to modify, update, enhance, patch, suspend, or discontinue, temporarily or permanently, the Application or any feature therein, with or without prior notice.
• Modifications to Terms: We may revise these Terms periodically. Revisions become effective immediately upon being published within the Application or on our official distribution channels. Your continued use of the Application following the publication of revised Terms signifies your irrevocable acceptance of such changes.

Termination

13. Termination

• These Terms remain in effect until terminated by either you or MoboDevs.
• You may terminate this Agreement at any time by permanently deleting, uninstalling, and destroying all copies of the Application in your possession.
• MoboDevs may terminate this Agreement immediately without notice if you fail to comply with any material provision of these Terms.
• Upon termination, all licenses granted herein shall immediately cease, but Sections 3, 4, 6.2, 6.3, 7, 9, 10, 11, 14, and 15 shall survive indefinitely.

Governing Law & Dispute Resolution

14. Governing Law & Dispute Resolution

• Governing Law: These Terms and any dispute arising from or related to the Application shall be governed by and construed in accordance with the laws of the jurisdiction in which MoboDevs operates, without regard to its conflict of law principles.
• Informal Resolution: In the event of any controversy, claim, or dispute, you and MoboDevs agree to first make a good-faith attempt to resolve the dispute informally by contacting rdxtoolss@gmail.com with a detailed description of the matter.
• Dispute Venue: Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts of the applicable operating jurisdiction, and you irrevocably submit to the personal and subject-matter jurisdiction of such courts.

General Provisions

15. General Provisions

• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
• No Waiver: No failure or delay by MoboDevs in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete and exclusive agreement between you and MoboDevs concerning the subject matter hereof and supersede all prior understandings, agreements, or communications.
